NYS to Require Booster Under Health Care Vaccine Mandate

In Governor Hochul’s COVID-19 briefing on January 7, the Governor announced that New York’s existing health care vaccination mandate will be expanded to require health care employees to receive booster shots within two weeks of eligibility. The Governor stated that the requirement will be presented to the Public Health and Health Planning Council for approval on Tuesday (January 11), either as a new regulation or as an amendment to 10 NYCRR § 2.61 (“Prevention of COVID-19 Transmission by Covered Entities”). Once approved, the requirement would take effect immediately. 

The regulation is not publicly available at this time and may contain additional details that were not discussed at the briefing. We will provide additional updates when they become available.
