DOJ Playbooks: New Covers, Same Rules?

Manatt Trial, White Collar and Investigations Partner Randy Grossman and Litigation Associate Misa Eiritz wrote an article for Daily Journal on the history of and potential changes to the Department of Justice’s (DOJ) corporate compliance guidance ahead of the new administration’s takeover in 2025.  

Grossman and Eiritz described the history of these DOJ policies and guidance, noting that although each administration has its own priorities and focus, it’s likely that the longstanding guidance and enforcement policies will stand. They continued, explaining that there will undoubtedly be changes under the new administration, but the established policies related to corporate compliance and cooperation that have evolved under multiple administrations for decades are unlikely to see significant revisions in the near future. 

“While DOJ's priorities and focus will certainly shift, if the past is prologue, many of the longstanding enforcement policies and compliance guidance embraced and promulgated by DOJ over the years are likely to remain intact,” they wrote.
