Ken Friedman is a partner in the firm’s litigation practice. His practice focuses on complex commercial litigation, with an emphasis on construction and land use disputes. Ken represents clients in federal and state court and in arbitration proceedings throughout the country. Experience
- Lead counsel for not-for-profit health care provider in action filed against it in New York state court challenging ownership of parcel in Lower Manhattan. Trial court granted health care provider’s motion to dismiss on the pleadings; successfully argued appeal affirming dismissal.
- Lead counsel for major railway infrastructure company in arbitration proceeding brought against it by subcontractor alleging breach of contract. Case resulted in arbitral award in favor of railway infrastructure company. Successfully upheld award in New York State court.
- Represented national rail carrier in multiple dispute resolution board proceedings arising out of electrification of carrier’s northeast corridor in connection with the initiation of high-speed rail service. Disputes were resolved via global settlement.
- Lead counsel for prominent orthopaedic surgeon in dispute with former partners in New York State court. Case settled on favorable terms at jury selection.
- Lead counsel for major media outlet in action filed in federal court in New Jersey alleging wrongful termination. Case settled on favorable terms prior to the close of discovery.
- Lead counsel for major retailer in multiple land use actions filed in New York and New Jersey State courts challenging municipal approvals for shopping center developments.
- Lead counsel for major infrastructure and construction firm in partnership dispute in New York State court alleging breach of agreements concerning performance of construction contracts for New York City Department of Environmental Protection.
- Co-lead counsel for major bio-medical manufacturer in action filed in federal court in Brooklyn, New York alleging defective prosthetic device.
- Lead counsel for major cinematic exhibitor in putative class action filed in New Jersey State court alleging that exhibitor’s gift card program violates State consumer protection laws.
