Believe it or not, more class action litigation is coming to California in 2020. Under the California Consumer Privacy Act (CCPA), the introduction of statutory damages and a private right of action for California businesses suffering data breaches all but guarantees that eager plaintiffs’ attorneys will file suit and ask questions later upon the faintest notion of a potential incident. This webinar discusses those provisions, their potential applications by the active California plaintiffs’ bar, and practical takeaways for businesses to implement now in order to minimize litigation risk.

But there are also hidden lawsuits lurking in the CCPA. Gone relatively unnoticed is the CCPA’s role in enabling valuable discovery for prospective plaintiffs. For example: Is your privacy policy ready to be scrutinized after you disclose all personal information that your company collects on a given customer? What new arguments regarding standing and damages will be tested in light of the introduction of statutory damages by the CCPA and other proposed privacy laws?

Presenters from Manatt’s privacy and data security team:

  • Discuss the fundamental rights provided under the CCPA
  • Highlight the unique litigation risks the CCPA rights create
  • Explore the application of existing case law to theoretical claims emanating from the CCPA
  • Identify best practices in minimizing this new litigation risk in the coming age of comprehensive privacy legislation
