NFL Concussion Settlement Objectors Challenge Jurisdiction
The Third Circuit recently approved the settlement between retired NFL players and the NFL regarding concussions. Last week, however, a petition for en banc review was filed by the objectors to the settlement. The ground was that the court's ruling that so little is known about CTE in the living logically leads to the conclusion that there can be no case or controversy—and therefore no jurisdiction—on this issue. The chair of Manatt's sports law practice group, Ron Katz, commented on this petition in Forbes.com:
