At the National Advertising Division's Annual Conference - hosted by the Advertising Self-Regulatory Council and the Council of Better Business Bureaus - attendees will receive firsthand knowledge from leading in-house and outside counsel, judges, regulatory officials and NAD attorneys regarding legal trends and key issues in advertising claim substantiation, FTC enforcement priorities, social media disclosures, class action litigation, and many other topics.
Manatt partner Chris Cole has been invited to serve as a panelist in the session, "But What's the Industry Standard? Claim Substantiation and Issues in Product Testing." He will join Martin S. Zwerling (Associate Director, NAD), Abi Murthy (Executive Director, Consumer Market Research, AT&T Mobility), and John Brodersen (Associate General Counsel, Kimberly-Clark Corporation) to shed light on how courts, regulators and the NAD evaluate product testing and support for different kinds of claims in the absence of consensus-based industry standards.

ERSP Summit 2012
Electronic Retailing Self-Regulation Program

On October 3, 2012, the Advertising Self-Regulatory Council and the Council of Better Business Bureaus will host the Electronic Retailing Self-Regulation Program (ERSP) Summit immediately following the National Advertising Division Conference. The ERSP event is tailored to marketing and advertising professionals in the direct response industry and will focus on the proliferation of consumer testimonials in social media, claim substantiation challenges, and the role of the ERSP.
Manatt partner Ed Glynn will serve as a panelist in the session titled "The Life Cycle of a Direct Response Advertisement: From Idea to Execution" that will walk through the development of a direct response advertisement, including a discussion of potential legal and regulatory pitfalls to avoid along the way. Other participants on the panel are Peter Marinello (Director, ERSP; Vice President, CBBB), Vic Golio (Executive Vice President, Chief Media), and Jeff Tuller (Co-Founder and President, Savvier).

At the American Conference Institute's Legal, Regulatory and Compliance Forum on Over the Counter Drugs, leading legal and regulatory professionals - including FDA representatives - will address challenges facing the nonprescription drug industry, focusing on such issues as advertising and promotion, labeling, trademarks, trade names and line extensions, and the modernization of the OTC monograph system.
Ed Glynn has been asked to participate in a panel session, "Staking Your Claim: Balancing Competitive Advantage and Legal Exposure in the Advertising and Promotion of OTC Products," that will discuss advertising and promotion regulations for OTC monograph products and OTC NDA products, provide insight into FDA and FTC authority in OTC advertising and promotion, and explore Lanham Act challenges relative to false and misleading claims for competitor products.
