Manatt Health Partner Randi Seigel and Manager Annie Fox were quoted in InsideHealthPolicy about the continued emergence of state health artificial intelligence (AI) laws and how the resulting patchwork landscape is impacting health care stakeholders.
The article explained the growth of state AI regulations addressing “health use” and explained how states are continuing to pass their own laws in the absence of a federal framework. “States are taking immediate action because Congress has not taken legislative action and the guidance coming out is non-binding and [a] patchwork,” said Seigel.
Fox discussed California’s SB 1120 as an example of one of these pieces of legislation, which would require physicians to review AI tools used to inform authorization and coverage decisions. The bill is notable as one of the few pieces of state legislation to focus on health payers, said Fox, adding that it could soon be signed into law.
