Manatt Privacy and Data Security Partner Brandon Reilly was featured in a Q&A with The Recorder where he provided insights into the new artificial intelligence (AI) and data broker regulations recently voted in by the California Privacy Protection Agency Board.
Diving into the current landscape of AI regulation, Reilly discussed key impacts of these new rules requiring privacy risk assessments and the regulation of AI technologies, including how they will be relevant to industry players and potentially affect litigation in this space. Referencing the data breach provision of the regulations, Reilly commented that regulated businesses may need to file a comprehensive impact assessment even after filing their initial abridged report.
“What that means is that, of course, it's going to significantly increase visibility of the regulator into each regulated business's data practices. It's also possible that these reports could be discovered in civil discovery or subject to a subpoena. And that's certainly what I think you can expect the most creative plaintiffs would do,” said Reilly.
