Manatt Health Senior Manager Jacqueline Marks Smith was quoted in Law360 on the Centers for Medicare and Medicaid Services’ (CMS) recent efforts to extend pandemic era telehealth policies ahead of the new Administration’s takeover in January. 

In the article, Marks Smith noted that CMS’ legislation, which is an iteration of the Telehealth Modernization Act of 2024, would extend the most important Medicare flexibilities, such as ones involving geographic restrictions and originating site restrictions. “The majority of telehealth services will only be available to Medicare beneficiaries in rural areas and from clinical sites. Except for in limited situations, Medicare enrollees will no longer be able to participate in a telehealth visit from home,” she said.
