Manatt Health Partner Cindy Mann spoke on a KFF webinar panel about how the overturning of Chevron deference will affect the creation of health policy legislation, regulation and program implementation.
When federal law was unclear, Chevron required federal courts to defer to agency interpretation. With the end of Chevron, agencies no longer will receive deference, leading to potential challenges against regulations. “Certainly agencies, their general counsels, their leadership, will be more cautious about undertaking rulemaking, more cautious about changing their rules over time,” Mann said in an article by Chief Healthcare Executive.
