Manatt Health Partner Michael Kolber was quoted in Law360 on the creation of state prescription drug affordability boards (PDABs) to evaluate and address prescription drug affordability.
As state PDABs impose upper payment limits (UPLs) on drugs, lawsuits from major drug companies are likely to increase. Referring to a suit brought against Colorado’s PDAB by a multinational pharmaceutical company for placing the first UPL on one of its drugs, Kolber said, "We're one-for-one so far. I assume additional manufacturers in states with the authority to use a UPL will sue."
