Manatt Employment and Labor Leader Esra Hudson was quoted in a Law360 article on the future of A.B. 5 challenges in California and how future action surrounding the law will likely shift from litigation to the ballot box.
After the California Supreme Court declined to review another recent challenge to A.B. 5, Hudson commented that the initiative process will likely be the battleground to watch on this issue, with multiple recent challenges to the law failing to find traction in court. “Given the success of the initiative process in exempting gig drivers from A.B. 5, I think we can expect to see additional initiatives to curb the breadth of A.B. 5, carve out additional exceptions and possibly repeal it altogether,” she said.
