Manatt Antitrust and Competition Partner Dylan Carson was quoted in The Real Deal on the Department of Justice’s (DOJ) antitrust focus on the real estate industry and the National Association of Realtors (NAR).
In the article, Carson explained, “Once real estate started becoming a big part of the economy after World War II, there was plenty of antitrust focus.” As such, the DOJ targeted NAR’s barring of internet-based brokers’ access to real estate listings in 2005. Even before the inquiry, Carson added, the organization was facing several lawsuits over their policies prohibiting nonmembers from accessing the Multiple Listing Network (MLS) database.
