Manatt Financial Services Partner Bryan Schneider was quoted in Law360 about how consumer reporting agencies can comply with Fair Housing Act (FHA) regulations in their tenant screening reports in light of the Biden administration’s recent January Blueprint for a Renters Bill of Rights addressing unfair practices in the rental market.
The Administration’s recent Blueprint seeks to reform the tenant screening process as the volume of complaints received about tenant screening increases, with advocates pushing for additional qualifications that would require companies to adhere to certain accuracy, fairness and privacy standards. Schneider cautioned companies to be aware of potential issues surrounding FHA compliance for these screening reports. "If you're using artificial intelligence and other sorts of machine learning, make sure that you understand them," Schneider said. "Make sure you have pressure tested them for the potential disparate impact on protected classes of individuals. That does need to be top of mind for anyone who is working in that space."
