Antitrust and Competition Partner Stephen Libowsky was quoted in The National Law Journal on the Federal Trade Commission’s ongoing efforts to prevent what it considers to be anti-competitive corporate mergers.
In particular, Libowsky noted that the FTC has used a variety of measures to prevent such deals from closing, including court actions, and even blocking mergers altogether if appropriate compromises cannot be reached. “There are times the agency says, ‘No, we’re going to push this to the end,” Libowsky said. “The parties and the agencies do push it to the end, and you end up with a resolution by the court as opposed to resolution by settlement.”
