Manatt Health Partner Rachel Sher was quoted in Law360 on states’ efforts to restrict access to mifepristone, the drug commonly utilized for medication abortion, after the U.S. Supreme Court’s decision in Dobbs v. Jackson Women's Health Organization. “These efforts are likely to intensify,” said Sher, adding that "courts will be faced with determining whether a state-based ban of mifepristone violates the Supremacy Clause and is therefore preempted… There is little precedent on these questions and therefore limited guidance on how courts are likely to rule," she said.
