Manatt Health Partner Michael Kolber and Litigation Partner Harvey Rochman were quoted in a Law360 article about how the No Surprises Act, which shields patients from certain out-of-network invoices, will be enforced and regulated in 2022.
Kolber and Rochman discussed how the NSA's key provisions will affect health care providers and healthcare payors as they work to resolve reimbursement among themselves. "We are poised for an extraordinarily bumpy rollout for the No Surprises Act, given the magnitude of operational changes both health insurers and providers need to make in a short period of time," commented Kolber. Recent federal cases will also influence how the arbitration process works, raising issues "regarding how out-of-network rates will be set where the parties cannot agree, which is fundamental to the balance of power between payors and providers in contract negotiations," Rochman added.
