In a Law360 article, employment and labor partner Deborah Kelly commented on a New York federal judge’s decision that determined a nondisclosure agreement signed by a 2016 Donald Trump presidential campaign employee is unenforceable. Kelly asserted that if the contract other staffers signed has language of similar scope and ambiguity that was used in this case, then other employees “the president and his team have gagged are ungagged.” The publication noted that the ruling could pave the way for additional litigation.
