Manatt Health partner Randi Seigel spoke with Modern Healthcare on the COVID-19 pandemic’s potential impact on the proposed changes to Stark Law, especially as it relates to the rulemaking process. In the article, Seigel noted that because officials expect multiple waves of this virus, the federal government can create new exceptions under Stark Law that the current Stark waivers go into effect upon the declaration of public health emergency. Other than that change, Seigel stated: "I don't see the proposed rules changing in any meaningful way in response to the pandemic. [But] the pandemic further exposed the disparities in health based on social determinants of health," underscoring the need for the proposed changes to the Stark Law to be adopted.
