Leader of Manatt’s investigations and white collar defense practice John Libby and pro bono director Scot Fishman spoke with Law360 about the firm’s motion to intervene on behalf of several voter advocacy organizations in a pair of Republican challenges to California Governor Gavin Newsom's order to send mail-in ballots to every registered voter. In the article, they discussed how the Supreme Court’s 2013 decision in Shelby County v. Holder has led to a huge increase in the volume of voting rights cases. In particular, Libby noted that “there could be litigation over the use of mail-in ballots, over how things were counted, how the ballot was designed, all that sort of stuff.” Even so, Fishman told Law360 that he “can't imagine us having to litigate a California mail-in ballot case prepandemic.”
