Manatt Health partner Robert Belfort was quoted in Bloomberg Law following the Department of Health and Human Services' decision to issue a 1135 waiver to temporarily relieve hospitals of certain administrative obligations under the Health Insurance Portability and Accountability Act (HIPAA) requirements in light of COVID-19. In the article, Belfort notes that not having to share privacy notices during a national emergency might be a good thing for hospitals, saying, “I suppose not having to distribute privacy notices—which can be an administrative annoyance—is good because hospitals won’t have to deal with that burden when they’re already trying to figure out how to handle certain situations during critical conditions. Any flexibility at this point is helpful.”
