Manatt’s energy and environmental practice leader Craig Moyer spoke with Law360 on the Trump administration’s dispute with the state of California over vehicle emissions standards. The U.S. Environmental Protection Agency and the Department of Transportation warned the California Air Resources Board that its recent voluntary agreement with Ford, Honda, BMW and Volkswagen to tighten emissions standards beyond federal requirements is unlawful. Moyer said it appears that “the battle is engaged” between the two federal agencies and the California Air Resources Board, and “it’s clear the administration is prepared to take incredibly aggressive positions that are unprecedented, in my experience.”
