Manatt’s Robert Jacobs, co-chair of the firm’s entertainment, sports and media litigation practice, was interviewed by the Daily Journal for an article on the legal battle between Redbox LLC and Disney.
The publication noted that the ongoing lawsuit revolves around Redbox’s alleged exploitation of Disney’s “combo packs,” which include Blu-Ray and DVD copies of films. Disney claims that Redbox is purchasing the combo packs from third-party retailers in order to sell them individually through their video rental service.
Jacobs explained that the recent filings are full of sound and fury but that they may end up signifying nothing.
“I think Redbox has a lot riding on this, and I think they have more of an uphill battle,” Jacobs said. “But at this point, it’s likely the judge will decide to proceed to discovery to develop a more fulsome record.”
