Law360 interviewed Manatt’s Christine Reilly, chair of the firm’s TCPA compliance and class action defense practice, for an article on the Seventh Circuit’s decision to add to limitations that companies face when making offers of full relief to individual plaintiffs in TCPA class actions, in order to ward off class certification. The decision makes the tactic, known as “pick-offs,” harder to attempt than ever before.
"The Seventh Circuit, as well as other courts, has continued to press the idea that the named class representative should have a chance to pursue class certification," said Reilly. "This means that unless the defense has other strategies to defeat the case, these cases will likely be litigated through class certification."
