Kozinski’s Cases to Be Reassigned to Active 9th Circuit Judges

Manatt’s Ben Shatz, co-chair of the firm’s appellate practice, was quoted in the Daily Journal for an article on the future of Ninth U.S. Circuit Court of Appeals Judge Alex Kozinski’s more than 50 pending cases. Following his recent resignation, these cases are currently under submission to the court.

His removal from the pending cases does not automatically require new oral arguments or briefings, and the 2018 calendar of cases that were already assigned to Kozinski has been redistributed to other judges.

“The Ninth Circuit is slow in moving cases, so this won’t really change how quickly an opinion comes down,” said Shatz. He explained that the only cases on which Kozinski’s departure will have an impact are those in which Kozinski was a swing vote on a panel of three judges whose opinions were split.
