Law360 covered Manatt’s successful representation of SQM US Inc. against alleged TCPA violations. Christine Reilly, co-chair of the firm’s TCPA compliance and class action defense practice, strategically employed arguments from the U.S. Supreme Court’s decision in Spokeo, Inc. vs. Robins from 2015 to get the case dismissed.
Reilly argued that the plaintiff, who brought claims for negligent and willful violation of the TCPA on behalf of others who received autodialed calls to their cellphones without giving permission, failed to plead an injury-in-fact as required by Spokeo. A California federal judge agreed, holding September 29 that the plaintiff didn’t connect alleged injuries like having to recharge his phone to TCPA violations.
