Law360 covered the latest update in an insider trading case against former Baltimore Orioles third baseman Doug DeCinces, who is represented by Manatt litigation partner Kenneth Julian, reporting that DeCinces’ defense has requested a California federal court cut 19 charges from the indictment. DeCinces’ counsel says the government’s case fails to allege a key element of the charge.
The motion to dismiss notes that there is a "fatal error" in the superseding indictment alleging James V. Mazzo, the former head of a California medical device company, told DeCinces that his company was about to be bought. DeCinces is now facing 19 counts of insider trading, 19 counts of tender offer fraud and one count each of securities fraud and money laundering.
In addition to Julian, the Manatt trial team includes associate Garrett Mott.
The case is USA v. Mazzo et al., case number 8:12-cr-00269, in the U.S. District Court for the Central District of California.
