September 12, 2013 - Reuters turned to Manatt's Edward Burg, a partner in the firm's Litigation Division, for insight into a lawsuit that trustees and mortgage investors have filed against the city of Richmond, California, to stop the city from using its power of eminent domain.
Reuters reports that a federal judge thinks that the case should not be addressed until the city actually decided to invoke eminent domain to seize underwater mortgages. He will rule next week whether the lawsuit should be dismissed or put on hold.
Burg told Reuters that he sees the city prevailing on the injunction matter. But Richmond risks costly, lengthy lawsuits in state court if it goes through with eminent domain actions, he said.
