"Fuhu Targets Toys R Us Over Kids Tablet Trade Secrets"

September 24, 2012 - Manatt partners Ronald Katz, Robert Becker and Shawn Hansen, all of whom are in the firm's Intellectual Property Practice, are representing tech company Fuhu Inc. in a trade secrets and trademark infringement suit against Toys R Us Inc. Fuhu argues that after it entered into an exclusive distribution agreement with Toy R Us to market its kids-oriented Android Nabi tablet, the toy retailer copied its design and business plans for use in its Tabeo tablet. Fuhu also claims that Toys R Us violated the agreement terms by doing virtually no promotion for the device and ordering quantities that were commercially unreasonable given the tablet's high demand.
Fuhu is bringing claims for breach of contract, breach of implied covenant of good faith and fair dealing, fraud, trade secret misappropriation, conversion, false designation of origin and unfair competition, trade dress infringement, trademark infringement, false advertising, unfair competition, and unjust enrichment.
It is seeking a jury trial; compensatory, punitive and treble damages; injunctive relief; a temporary restraining order; restitution; an order of the surrender of all Tabeos to Fuhu; and an accounting.
The case is Fuhu Inc. et al. v. Toys R Us Inc. et al., case number 3:12-cv-02308, in the U.S. District Court for the Southern District of California.
