For legal and compliance practitioners operating in the health care industry, the Loper decision, overturning the Chevron decision, is perhaps one of the most impactful decisions in decades. Under Chevron, ambiguity in a statute was considered a delegation by Congress to the agency to fill in.  Thus, unless an agency’s decision (or any reinterpretation) of a statute was wholly unreasonable, it would be upheld. The Loper decision now returns the authority to interpret an ambiguous statute to the courts, with the agency’s interpretation receiving deference based on its power to persuade.  This webinar will explore the far-reaching implications of Loper in the context of the health care industry.
