Pimstone Recognized on Daily Journal’s 2025 Leading Commercial Litigators List

Manatt Health Partner  was recognized as one of the Leading Commercial Litigators of 2025 by Daily Journal, which honors top attorneys across California in bet-the-company litigation.  

A trial lawyer who represents California’s largest health care entities, Pimstone was highlighted for his career as well as his recent representation of Kaiser in a multimillion-dollar lawsuit filed by Long Beach Memorial Medical Center, claiming that the insurance company underpaid for emergency services provided to patients. Based on a fair market analysis, he argued that Kaiser paid an appropriate amount and Long Beach Memorial’s tort claim that Kaiser intentionally underpaid them was invalid.  

“There are very different theories between hospitals and payers about what a reasonable market value for emergency services would be when there's no contract,” Pimstone said. “In an emergency, patients are often taken to the nearest emergency room whether or not the hospital has a contract with their insurance company. The law says you've got to give uncontracted patients the same market price as you do contracted patients. In this case, the hospital tried to only look at specific transactions for determining fair market value.”
