Changes and Challenges: The 2024 Appellate Year in Review

In his latest column for Daily Journal, Manatt Appellate Partner Benjamin Shatz explained the most significant appellate news from 2024. 

Some of the notable developments he discussed included:  

  • Attention on the U.S. Supreme Court due to its new ethics code and the number of information leaks reaching reporters. 
  • The Judicial Council of the Ninth Circuit’s unpublished order publicly reprimanding and admonishing a district court judge for creating a hostile work environment and having an inappropriate relationship with one of his law clerks. 
  • President Biden’s record-breaking circuit judge appointments, adding more women and people of color than any other president ever, and flipping the 2nd Circuit to a majority of Democratic-appointed judges. 
  • New rules changes for the Federal Rules of Appellate Procedure, Ninth Circuit Rules and California Rules of Court. 
  • Appellate opinions on the developing points of certain elements of the practice, including appealing administrative mandate cases, technical issues with electronic filings and presumed prejudice for denial of relief from a jury waiver.
