Manatt Health Partner Randi Seigel co-authored an article discussing the state of artificial intelligence (AI) in health care, where AI policy is and where it’s going.
When creating policies, health care regulators aim to assess the value of AI while also preventing potential threats, the authors explained. This can be difficult since AI is not used in a universal manner and effective rules would need to be specific to each technology and area of health care. Federal and state regulators have displayed concerns both about AI in general and specifically within the health care industry, with many having recently issued rules regarding AI safety, use and transparency.
“Health care is a super regulated industry, which makes it even more challenging for AI companies to find footing. There aren’t yet many concrete laws in place specific to health AI, in part because regulators are still in learning mode,” the authors wrote. “States should consider authorizing the creation of guidances that can be more flexible to respond to the evolution of AI.”
