Bio

David T. Schur

David Schur represents management in employment disputes in federal and state courts, before administrative agencies and in arbitration, counseling companies on all aspects of employment law and conducting internal workplace investigations. He defends employers against discrimination, retaliation and harassment claims, as well as allegations of federal and state wage-and-hour laws violations. David also handles litigation over noncompetition agreements.

Employers turn to David for advice on worker classification issues, including whether workers should be classified as employees or independent contractors, and whether employees should be classified as exempt or nonexempt under the Fair Labor Standards Act. He also counsels clients on wage-and-hour requirements under the FLSA and related state laws.

David drafts employee handbooks and policies, and creates, implements and enforces employment agreements, noncompetition agreements and separation agreements. He advises management on reduction in force processes; federal and state Worker Adjustment and Retraining Notification Act (WARN Act) compliance; compliance with the National Labor Relations Act (NLRA); and the leave provisions of the Family and Medical Leave Act (FMLA), Uniformed Services Employment and Reemployment Rights Act (USERRA) and related state laws.

In addition, David counsels companies on Title VII, Age Discrimination in Employment Act (ADEA) and related federal and state nondiscrimination requirements. He advises clients on how to implement reasonable accommodation under the Americans with Disabilities Act (ADA) and related state laws, as well as on the interaction between the ADA and FMLA and other leave laws. He also helps companies address drug- and alcohol-free workplace issues, as well as social media-related issues.

Prior to his law firm experience, David clerked for the Honorable Harris L Hartz of the U.S. Court of Appeals for the Tenth Circuit and worked as a staff attorney for the U.S. Court of Appeals for the District of Columbia Circuit.
