Successfully represented household brands in Single Well-defined Issue Fast Track challenges as both the challenger and the advertiser.

Successfully challenged a host of competitor claims, including superiority, “Made in USA,” defamatory and endorsement claims, in a complete win for a major retail client.

Successfully challenged a major telecommunications company’s national “most reliable 5G network” advertising before the NAD and NARB on behalf of a leading telecommunications company, resulting in claim discontinuance.

Successfully challenged another major telecommunications company’s national “Best Network” advertising before the NAD and NARB, resulting in claim discontinuance.

Successfully defended a major internet provider’s “fastest speed” claim before the NARB—as the advertiser in the proceeding—convincing the appellate body to reverse nearly a decade of precedent in allowing such a claim to include the analysis of upload speeds.

Regulatory

Obtained a favorable settlement on behalf of a major retail client in one of the FTC’s first Section 5(m)(1)(B) proceedings following the Supreme Court’s AMG holding.

As a member of the litigation team, obtained a complete reversal and remand at the U.S. Court of Appeals, D.C. Circuit, of a Federal Communications Commission rulemaking severely limiting the ability of Lifeline carriers to receive compensation.

Obtained a favorable settlement against a major telecommunications carrier in a tariff dispute before the New York Office of Telecommunications.

Civil Litigation

Acted as lead counsel in litigation defending a trade association from defamation claims by a foreign manufacturer, obtaining complete dismissal in a motion to dismiss in the U.S. District Court for the District of Columbia, with the ruling affirmed by the D.C. Circuit and cert denied by the Supreme Court.

Successfully obtained a preliminary injunction against the state of California on behalf of a consortium of distributors and manufacturers.

As a core member of the litigation team, prevailed in a class action against the Social Security Administration, resulting in over $70 million of payment to the class and approximately $16 million in attorneys’ fees.

Second-chaired a three-day bench trial resulting in a complete win for a major regional real estate client.
