Going Deep on Deepfakes — Recent Legislative Developments and Real-World Impact

As artificial intelligence usage continues its explosive growth, the United States Congress, federal agencies and state legislators alike have sprung into action, proposing and adopting various new pieces of legislation aimed at safeguarding individuals’ rights against so-called “digital replicas.” These bills—including the Nurture Originals, Foster Art, and Keep Entertainment Safe (“NO FAKES”) Act of 2024; Tennessee’s Ensuring Likeness, Voice, and Image Security (“ELVIS”) Act of 2024, and more—are changing the legal landscape around privacy and rights of publicity at a rapid rate.

Manatt Entertainment Litigation Partner Sarah Moses will be joined by Manatt Entertainment Litigation Partner Nathaniel Bach; Manatt Privacy and Data Security Partner Paul Luehr; Jeffrey Bennett, General Counsel for SAG-AFTRA; and Ben Sheffner, Senior Vice President & Associate General Counsel, Law & Policy, for the Motion Picture Association, for a lively discussion about these developments, prospects for passage of pending bills, and how companies and artists can adapt to new changes in the law and ensure their rights are protected.
