Citizen Question on Census Threatens Democracy, California Judge Rules

Manatt’s John Libby, leader of the firm’s investigations and white collar defense practice, spoke with Bloomberg about a California judge’s recent ruling in a lawsuit challenging the Trump administration’s decision to ask people about their citizenship on the 2020 Census.

U.S. District Judge Richard Seeborg, a federal judge in San Francisco, ruled that “the addition of the question violated the Administrative Procedure Act, which governs changes to agency regulations,” according to Bloomberg.

In the lawsuit, Libby represented the City of San Jose, one of a number of California cities involved in the suit. He told Bloomberg the ruling is “another step in the fight against this administration’s anti-immigrant agenda” and said he looks forward to defending the ruling, “including in the Supreme Court.”

The Supreme Court has agreed to hear the Trump administration’s appeal of a similar ruling in a New York lawsuit on April 23.
