Seigel Quoted in Pluribus News on Proposed California Bills for AI Use in Health Care

Calif. poised to set guardrails for AI in health care

Manatt Health Partner Randi Seigel was quoted in an article by Pluribus News discussing two proposed California bills aimed at regulating artificial intelligence (AI) use in health care. 

According to the article, while numerous state legislatures this year have considered AI bills, only a small portion have focused on AI in health care. While similar laws are expected to be introduced in California this year and in a few other states next year, mass adoption of these types of laws may take longer, “as many states will still be studying how they want to legislate AI through their task forces and councils that were created under this years’ laws,” Seigel said.  

One of the proposed bills aims to prevent discrimination from software used in coverage decisions by requiring a physician to review any modification or denial of a health plan. “This bill, similar to CMS’s guidance, appears to strike a fair balance between allowing a plan to use AI to improve efficiency in utilization review, while ensuring that a human reviews decisions (and agrees with decisions) that would have an adverse impact on the plan’s members,” she said.
