Manatt Antitrust and Competition Partner Dylan Carson was quoted in a Global Competition Review article discussing how the recently withdrawn collaboration guidance by U.S. antitrust agencies will impact companies and prosecutors alike.
According to the article, the 2000 Antitrust Guidelines for Collaborations Among Competitors were rescinded for their neglect to address technological advancements and dependence on outdated case law, despite proving useful for prosecutors. Without new guidelines to replace the old ones, compliance can be more difficult for organizations. “Guidelines are helpful, and withdrawing them without replacing them leads to challenges in helping companies which want to comply with the antitrust laws,” said Carson.
