AIS Health quoted Manatt’s Deborah Bachrach, a partner with Manatt Health, for an article about House Republicans’ efforts to prove the illegality of the Affordable Care Act. The lawmakers recently subpoenaed the U.S. Department of Health and Human Services for documents and information that would explain the agency’s decision to fund the ACA’s Basic Health Plan (BHP) program, despite not having approval from Congress.
If the House Republicans’ plan is successful, cost-sharing reduction payments will no longer be available, which will mean that insurance carriers would likely need to boost premiums. Many worry the BHP could not survive such a blow.
“While states would still be able to tap into the tax-credit dollars that would otherwise have been available to BHP enrollees, that is unlikely to be sufficient to support an affordable product,” Bachrach explained.
