In his most recent column for Forbes, Manatt Antitrust Partner David Reichenberg talked about practices businesses should adopt and avoid as the Democrat-led FTC pursues policies aligned with Biden’s antitrust agenda.
In the article, Reichenberg explained that with an FTC majority, Democrats are in a strong position to pursue President Biden’s “whole of government” approach to increase consumer choice and decrease concentration in a number of sectors. “There are four major areas where one can expect action,” Reichenberg explained, including, “labor freedom/mobility, privacy and related data collection, challenges to deals previously unchallenged, and any significant price increases on everyday/essential goods.” According to Reichenberg, there may be bipartisan consensus for certain topics, however Republican opponents can be expected to resist other efforts as overreaches of the FTC’s authority. Companies should avoid practices that identify them as the “poster-child” for any of the circumstances requiring FTC action, and “should do their best to be a part of the solution to these problems, rather than the opposite.”
