Politico interviewed Manatt's Joel Ario, a managing partner with Manatt Health, for an article on what will happen to the 7 million to 8 million people who will lose health subsidies if the Supreme Court invalidates a key provision of Obamacare.
Politico reports that the high court will hear arguments in King v. Burwell, a case that will determine whether the health law's premium subsidies are legal in states that did not set up their own insurance exchanges. If the court decides they're not, millions of people would be cut off, and the cost of insurance would rise sharply. If this were to happen, some industry insiders suggested that the court could craft a grace period to allow time to work out solutions; others expect the money to stop immediately.
"There will be have-states and have-not states, and the cleavages will be deeper and more painful than they are today," said Ario.
