Law360 interviewed Manatt's Christine Reilly, co-chair of the firm's TCPA Compliance and Class Action Defense practice, for an article on the Third Circuit's endorsement of the Federal Communications Commission's broad definition of "autodialer."
Law360 reports that the three-judge appellate panel ruled that, per its interpretation of the commission's July 10 declaratory opinion, autodialer is defined by its ability to store or produce numbers that are randomly or sequentially generated, even if the autodialer isn't used for that purpose.
"The key issue on remand is the system's 'capacity,' which the court found to be 'an issue of heightened importance in light of the 2015 FCC ruling,'" said Reilly.
