InsideCounsel interviewed Manatt's Jacqueline Wolff, co-chair of the firm's Corporate Investigations and White Collar Defense practice, for an article on how the FCPA remains an enforcement priority for U.S. regulators.
InsideCounsel reports that although the number of new cases has dropped from last year, the FCPA still makes it unlawful to make payments to foreign government officials to obtain or retain business. Lawyers told the publication that it is recommended that boards of directors get training on the FCPA and understand what their companies are doing to mitigate risk.
As with any white collar criminal investigation by the government, it is also important to be proactive. "If you have been proactive, it always puts you in a much better light," said Wolff.
