NewsWorks interviewed Manatt's Joel Ario, a managing director with Manatt Health, for an article on the steps that leaders in Delaware and Pennsylvania are taking in preparation for the King v. Burwell decision, which could jeopardize the health coverage of tens of thousands of people in the region.
Both states have submitted blueprints to the federal government to set up state-supported marketplaces, because the U.S. Supreme Court case argues that under the health law, discounts apply only to states that run their own marketplaces.
"Pennsylvania stands out," said Ario. He said while states may be exploring options behind the scenes, supporting an actual plan at this point "is a political nonstarter" for at least a third of states with federal marketplaces.
That's because it means "standing up and saying, 'I want to work with this law in a public way in a state-based exchange.'"
