Law360 reports the voters in Denton, Texas, will weigh in on a topic that has been attracting national attention. The initiative, if passed, would ban hydraulic fracturing within Denton city limits, and it could have widespread impact as other cities and states across the country wrestle with the question of fracking.
Moyer told Law360 that energy companies would likely test the measure in court if it passes. "If this measure in Denton passes, it is likely to be challenged as overbroad and perhaps as a taking," he said. "Oil and gas developers take these measures seriously and need to continue to work with the public to ensure accurate information about their activities gets out there."
