In a unanimous vote, the California Public Utilities Commission approved a 25-year power purchase tolling agreement between Manatt client Pio Pico Energy Center and San Diego Gas & Electric Company, clearing the way for construction of a 305-megawatt power plant in the Otay Mesa area of San Diego.
Manatt partner David Huard represented Pio Pico in the negotiations.
Terms calls for the plant to be functional by Sept. 1, 2015, with the flow of electricity to SDG&E starting in 2017.
A previous purchase agreement between the utility and power plant operators, with different terms, was rejected by the commission in March 2013.
