Manatt's Joel Ario, a managing director with Manatt Health, spoke to Law360 for an article on how the government subsidies on the Affordable Care Act's federal exchanges will almost certainly survive despite conflicting issues issued recently from two circuit courts.
Law360 reports that if subsidies were to disappear for those on the federal exchange, many people would no longer be able to afford coverage. Residents of states that created their own exchanges would still be able to get subsidies if their income was up to 400 percent of the federal poverty line, but residents of other states would get nothing.
"This would further deepen the cleavage between the states," said Ario.
