March 26, 2013 - Manatt's Jacqueline Wolff, co-chair of the firm's Corporate Investigations & White Collar Defense Practice, spoke to Law360 about the things a client should do and say to obtain the best possible outcome from a Foreign Corrupt Practices Act probe by the U.S. Department or Justice of U.S. Securities and Exchange Commission.
Law360 reports that the FCPA bars companies from making or offering improper payments to officials of foreign government in order to secure business. The publication asked top attorneys for tips on what to tell clients who are notified of a government investigation. They recommend taking it seriously, being candid and open, having a plan of action and studying the FCPA guidance.
"It's less scary if you're prepared for the initial investigation," Wolff said. "That eliminates the panic factor."
