Manatt Health Partner Kinda Serafi was quoted in Law360 about how states are leveraging Medicaid Section 1115 demonstration waivers to increase access to physical and behavioral health care for incarcerated individuals who are reentering the community.
After the Centers for Medicare and Medicaid Services (CMS) and the Department of Health and Human Services issued 2023 guidance to expand care under the Medicaid program, many states rushed to apply for the waivers, with California being the first to implement the program. "It was just a cascade of states that had followed pretty quickly, and CMS now is just working to move through and trying to get the approvals for all the states that have pending waivers in front of it," she said.
